Terms of use

The rules for selling on Kwimba.

These terms apply to everyone who opens or works in a store on Kwimba, a service of Kwimba Technologies. By using Kwimba, you agree to them.

Opening a store

  • By creating a store, you confirm that you are authorised to do so by the person, business or organisation it is for, and that you may agree to these terms on their behalf.
  • The details you give us about your store and your business must be true, and you must keep them up to date.
  • You are responsible for everything done under your account and your store, including by the people you add to it.

What you may not sell

  • You may not use Kwimba to sell, offer or advertise anything that is unlawful under the laws of Kenya.
  • That includes stolen or counterfeit goods, illegal drugs, and anything that needs a licence you do not hold.

Explicit and adult content

  • You may not sell adult products or services, or show sexually explicit or adult content, on your store. This covers products, photos, descriptions and anything else on your store.

Your store and your customers

  • What you list, the prices you set, and the orders you take are yours to stand behind. Your dealings with your customers, including delivery, refunds and taxes, are between you and them.
  • You must have the right to use the photos, names and other material you put on your store.

Access by Kwimba staff

  • Authorised Kwimba staff can access your store and its data, including your products, orders, customers and settings. They may do so to support you, when you ask us to act for you, to check that these terms are being followed, to keep Kwimba secure, or where the law requires it.
  • We keep a record of this access.

If these terms are broken

  • We may, at our discretion, remove content, take a storefront offline, or lock out any store or merchant account that we reasonably believe is involved in anything illegal or that does not comply with these terms.
  • We may also do this where the law requires us to, and we may do it without notice where we need to act quickly.
  • If you think we have got it wrong, write to us at hello@kwimba.co and we will look into it.

Changes to these terms

  • We may update these terms as Kwimba changes. The date below says when they last changed, and using Kwimba after a change means you accept the new terms.
  • These terms are governed by the laws of Kenya.
